Firstly, there are genuine reasons for extreme urgency.
GPHG must ensure its homes are correctly serviced in order to adhere to its work programme and ensure the safety and wellbeing of its tenants.
In line with GPHG's obligations as detailed in the Housing Act 2004 and Gas Safety Act 1998, GPHG has a requirement to ensure customers' safety.
GPHG is awarding a contract using Regulation 32 (2)(c) of the Public Contracts Regulations2015 to respond to the immediate public health risk in having no supplier to conduct the domestic gas servicing at GPHG's properties.
Secondly, the events that have led to the need for extreme urgency were unforeseeable and have made it impossible for GPHG to comply with the usual timescales in the Public Contract Regulations.
There is no time to run an accelerated procurement under the open or restricted procedures or competitive procedures with negotiation.
Furthermore, the situation is not attributable to the contracting authority.
GPHG will be going out to the market in January 2021.
